The gist of the Complaint : Translated from Marathi to English on best effort basis.

The Complainant (Sepoy id-130191), aged 36, resides at the above mentioned address with his family, who joined Mumbai Police department in 2013, and is presently serving in General duties dept at Agripada Police Station since 2020.     

I appeared at the police station for Night duty on August 14, 2022.

By the order of superiors, to take search and act against the drug addicts in the police station area, the Complainant along with PSI Mr. Shirsath left with the materials required for the Panchnama at 21:30 hrs. While patrolling in Tambit naka area at 22:00 hrs. patrolling staff received reliable information through a secret correspondent that behind the Tambit naka, byculla, Mumbai, one person is consuming narcotic drug- Ganja.

After that, Police Sub Inspector Shirsath asked the complainant to go and get two PANCH . After that, the complainant came with two PANCH in a short time. Police Sub-Inspector introduced both the PANCH to our police team and explained the purpose of calling the them to the said place, the PANCH agreed to appear as judges.

At 22:25 hrs, after keeping watch on him for some time, Police Inspector ordered to take him into custody. Accordingly squad officers detained him, found lighted Chillam with Ganja. After that, Sub-Inspector of Police identified himself, the Pancha and the police team to the accused and asked him to allow to search him, but he refused.

Then, Police Inspector asked accused about his whereabouts and what he was doing at that place, and he said that he was consuming ganja, a narcotic substance, by stuffing it into a chillam. Then he was asked his name and address, he gave his name as  Chetan Digambar Vichare, age 36 years and address as above.

When the accused was examined, his eyes appeared swollen and red due to drug consumption and his mouth smelled rough. Immediately, the accused was searched before the Pancha, 1) a Chilim 2) a dirty white cloth, 3) matchbox in his hand was seized, extinguished and destroyed on the spot. It was explained in Hindi to the accused that if there is any complaint against the search, he will be produced before the nearest Magistrate and Gazetted Officer, to which he refused. And then the accused was taken in custody and taken to police station for further interrogation.

Police Registered the case and took up the investigation The case is being investigated by the Police  officer namely Mr. Yogendra Pache.

The Complainant’s statement was recorded in Marathi and it was explained to him in Hindi  and he confirmed the same.
