The gist of the Complaint : Translated from Marathi to English on best effort basis.
The Complainant (Nayak id-060347), aged 38, resides at the above mentioned address with his family, who joined Mumbai Police department in 2006, and is presently serving in ATS dept at Agripada Police Station since 2016.
The Complainant appeared at the police station for day duty on 09/01/2023 at 9:00AM . On the orders of superiors to stop menace of Narcotics in area, at about 2:47 PM while Police sub inspector Mr. Kambli , Sepoy 92519/Shaikh and complainant were patrolling in Police Station Precinct near Meghraj Sethi Marg, Jhula Ground, Agripada, They saw a person was standing with black carry bag, in a suspicious manner .
After that, Police Sub-Inspector asked compainant to go and get two PANCH and. After that, sent complainant to fetch writing material for sealing, labelling, laptop, portable printer, brass stamp from Samtanagar Police Station, Mumbai . Police Sub-Inspector introduced both the PANCH to our police team and explained the purpose of calling them to the said place, the PANCH agreed to appear as judges.
After keeping watch on him for some time, Police Inspector Mr. Pushpak Ingale ordered to take him into custody. Accordingly, the Anti terrorist squad officers detained him. After that, P.S.I identified himself, the judges(panchas) and the police team to the accused . Then accused was asked about his name, age, occupation and address, he gave his name as Mohd Mumtaj Mohd Abid Shaikh, age 23 years and address as above. The accused was dressed in checkered blue shirt and blue jeans upto knees.
Police Sub Inspector (PSI) Mr. Kambli asked “What is in a black colored plastic bag?” to which accused said that it is “Ganja”. After that, he inspected the bag in the accused person’s hand and found Brownish material attached to the stems like leaves, flowers, seeds, sherds inside the bag. At that time Police Sub-Inspector asked Sepoy Shaikh to fetch an electronic weighing scale from Anti- Narcotics Branch, Worli Mumbai. Shortly thereafter Sepoy Shaikh returned to the spot with required material.
Police Sub Inspector Mr. Kambli informed the incident to P.I Mr sayyed by calling him via Mobile and requested him to come at the given spot of incidence. P.I Mr sayyed shortly arrived at such spot.
After that, P.I. Sayyed gave a written letter explaining the purpose of the body search to accused and also informed him in hindi language that under section 50 of the NDPS Act 1985, accused have the right to be searched before a nearby magistrate or gazetted officer. So accordingly the arrangements needs to be made, At that time accused denied it and verbally told the PANCHAS that he had no objection with immediate search.
After that accused signed the letter given , to confirm that he has received a copy and understanding of search on the spot, which then signed by both Panchas as witness. After that Police inspector Mr Sayyed gave opportunity to the accused to search the police team and the PANCHAS with his hands before searching his body. Accused verbally denied it
Then Accused person’s body was searched , accordingly black colored bag was in his hand was examined, it was found to contain strong smelling material containing leaves, flowers and seeds. Again before both the panchas , accused was asked about what is there in the bag, , to which he replied as “ganja”
After that , right before the Panchas, all the ganja including the black bag in the possession of the accused was weighed on a scale and it was found to be 800 grams (worth approx. Rs.8000/-). The said plastic bag with ganja was kept in a large paper envelope . Then label containing signatures of both Mr sayyed and Panchas was affixed on it , afterwards all four sides of the envelope were closed with thread . And applied hot lacquer on the knot of such thread . Finally, stamped and sealed it with Brass stamp of Agripada Police Station, Mumbai , named it as exhibit “A”.
Mr Kambli searched accused body again and found nothing which can be said as unusual and after that Mr Pushpak Ingthe accused was asked (before the PANCHAS) from whom he got the narcotic substance ganja, to which he gave vague answers.
Accused was then taken into the Police custody from the spot and the said goods are confiscated by the police team for further legal action . The Complainant lodged legal complaint against accused on behalf of the government as the accused was caught illegally in possessed, transported and sold Ganja, a narcotic drug, weighing 800 grams without licence.
Police Registered the case and took up the investigation The case is being investigated by the Police officer namely Mr. Yogendra Pache.
The Complainant’s statement was recorded in Marathi and it was explained to him in Hindi and he confirmed the same.
